Workplace changes and challenges in 2021

 

When it comes to managing a workplace 2021 may be the most challenging year in our lifetimes. Apart from dealing with the ongoing acute health and operational issues posed by COVID-19, it will be another year of significant change. 


In Federal employment law the government has sought to make numerous changes, including clarifying the rights of casual employees. As well, additional leave is now available to employees covered by the Fair Work Act. At a collective level the process of getting enterprise agreements approved has continued to be a significant problem.


The government has significant ongoing Royal Commissions focused on aged care, and, on disability.  The Commission focused on disability is considering issues like violence, abuse, neglect and exploitation - and hence will continue to examine a number of workplaces.


In New South Wales the Liberal-National Coalition will not face an election until 2023. Even during the current crisis the Coalition's policies focus heavily on infrastructure programmes. The government is also likely to introduce new legislation that will more closely regulate work in a number of industries, including construction and engineering. 


Finally, we predict that issues relating to privacy laws will move to the forefront in 2021. There are a variety of views about the workplace use of social media, surveillance, facial recognition technologies, and electronic records - many of which will likely end up in litigation. And one year ago who could have predicted vaccination might become a workplace issue. All in all 2021 will be a year of changes and challenges - in politics, law and regulation.


Clever businesses will anticipate the next big changes before they occur.
